Welcome to Whitestone House (the "Store"), available at https://whitestonehouse.shop. These Terms of Service (the "Terms") govern your access to and use of the Store and your purchase of any products through it. By using the Store or placing an order, you agree to these Terms. If you do not agree, please do not use the Store.

1. Who You Are Buying From

This store is operated by Shane Nash, an independent seller located at 145 Eden Street, Oamaru, Otago 9400, New Zealand. Contact: [email protected].

We refer to the operator above as the "Seller," "we," "us," or "our." The Seller is responsible for the designs, product listings, and content offered on this Store and provides first-line customer support for your orders.

These Terms are an agreement between you and the Seller. MyDesigns, Inc. (defined below) is also a party to, and may directly enforce, the payment, platform, disclaimer, liability, and dispute-resolution provisions of these Terms.

2. The Platform and Merchant of Record

The Store is built on and powered by MyDesigns, a platform operated by MyDesigns, Inc., a Nevada corporation ("MyDesigns"). It is important to understand the roles of the parties in your purchase:

MyDesigns, Inc. is the merchant of record for your purchase. MyDesigns processes your payment, appears on your card or bank statement, issues any refunds to your original payment method, and, where required by law, acts as a marketplace facilitator that calculates, collects, and remits applicable sales tax on the transaction directly to the relevant tax authorities.

MyDesigns coordinates fulfillment. Physical print-on-demand products are produced and shipped through MyDesigns' network of professional print and fulfillment providers. Digital products are delivered through the MyDesigns platform.

The Seller is responsible for the products themselves — the designs, artwork, descriptions, and pricing — and for handling your questions about orders, products, and this Store.

MyDesigns does not claim ownership of the Seller's store, designs, or brand.

Because MyDesigns is the merchant of record, the charge on your payment statement may appear under a descriptor referencing MyDesigns, the Store, or both.

3. Eligibility and Geographic Availability

You must be at least 18 years old (or the age of majority in your jurisdiction) to make a purchase, or use the Store under the supervision of a parent or legal guardian who agrees to these Terms. You agree to provide accurate, current, and complete information when placing an order.

Products on this Store are currently available for purchase and delivery within the United States only. Physical products can be shipped only to United States addresses, and digital products are currently available only to buyers with a United States billing address. We may expand availability to additional countries in the future, in which case availability will be indicated at checkout.

4. Orders and Order Acceptance

Your order is an offer to purchase, which is accepted when we send you an order confirmation. We (together with MyDesigns) reserve the right to refuse, cancel, or limit any order — for example, in cases of suspected fraud, payment issues, pricing or listing errors, undeliverable addresses, or orders that violate these Terms. If an order is cancelled after payment, you will receive a full refund to your original payment method.

5. Prices, Payment, and Taxes

All prices are listed in U.S. dollars unless otherwise indicated. Prices and product availability may change at any time without notice, but changes will not affect orders that have already been accepted.

Payments are processed securely by Stripe on behalf of MyDesigns as merchant of record. By submitting a payment method, you represent that you are authorized to use it. We do not store your full card number on our systems.

Applicable sales tax is calculated and displayed at checkout. Where required by law, MyDesigns collects and remits sales tax as a marketplace facilitator on behalf of the Seller.

Discount codes and promotions are subject to the conditions displayed with the offer and may be modified or withdrawn at any time.

6. Products

Physical Print-on-Demand Products

Physical products in this Store are custom-made for you at the time of purchase — we do not hold pre-printed inventory. Because each item is printed on demand, minor variations in color, print placement, and sizing may naturally occur and are not considered defects. Product images are for illustration; colors may appear differently depending on your screen settings. Please review the sizing charts on product pages carefully before ordering.

Digital Products

Digital products are delivered electronically after successful payment. Unless the product description expressly grants broader rights, you receive a limited, non-exclusive, non-transferable license to use digital products for personal use only. You may not resell, sublicense, share, publish, or redistribute digital products or use them to create products for sale, unless commercial rights are explicitly stated in the product description. All rights not expressly granted are reserved by the Seller.

7. Shipping and Delivery

Shipping is governed by our Shipping Policy, which is incorporated into these Terms. Production and delivery timeframes shown at checkout or on the Store are good-faith estimates, not guarantees. Risk of loss and title for physical products pass to you upon delivery of the item to the shipping carrier; however, our Refund & Return Policy still protects you for items that arrive damaged, defective, or are lost in transit.

8. Returns, Refunds, and Cancellations

Returns and refunds are governed by our Refund & Return Policy, which is incorporated into these Terms. In summary: misprinted, damaged, or defective items are replaced or refunded free of charge if reported within 30 days of delivery; because physical items are made to order, we generally cannot accept returns for buyer's remorse or sizing errors; and digital product sales are final once the product has been delivered or accessed, except as described in that policy. Refunds are issued by MyDesigns, as merchant of record, to your original payment method.

If your issue is not resolved, you may escalate to MyDesigns at [email protected] with your order number. Please contact us before initiating a dispute with your bank or card issuer — we can almost always resolve issues faster directly.

9. Reviews and User Content

The Store may allow you to submit product reviews, ratings, photos, or other content ("User Content"). By submitting User Content, you grant the Seller and MyDesigns a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content in connection with the Store and the products, and you represent that your User Content is your own, is accurate, reflects your genuine experience, and does not violate any law or third-party rights. We may remove User Content that is unlawful, deceptive, offensive, or otherwise violates these Terms, and we may decline to publish reviews that are fraudulent or unrelated to a genuine purchase.

10. Intellectual Property

The designs, artwork, product listings, and Store content are owned by the Seller or its licensors. Purchasing a product does not transfer any intellectual property rights to you beyond the limited license expressly described for digital products. The Seller represents that it owns or holds the necessary rights for the designs and content displayed on this Store.

MyDesigns and its print and fulfillment partners provide the technical platform and manufacturing infrastructure and do not pre-screen or approve the designs uploaded by sellers. If you believe content on this Store infringes your copyright, trademark, or other rights, please submit a report through MyDesigns' intellectual property policy at mydesigns.io/dmca.

11. Acceptable Use

You agree not to misuse the Store, including by: interfering with its operation or security; accessing it through automated means such as bots or scrapers without permission; placing fraudulent orders or using stolen payment credentials; misrepresenting your identity; or using the Store in violation of any applicable law.

12. Disclaimers

Except as expressly stated in these Terms and our Refund & Return Policy, the Store and its content are provided "as is" and "as available," and, to the maximum extent permitted by law, the Seller and MyDesigns disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Store will be uninterrupted or error-free. Nothing in these Terms limits any warranty or consumer right that cannot be excluded or limited under applicable law, and you may have additional rights under the laws of your state of residence.

13. Limitation of Liability

To the maximum extent permitted by law, neither the Seller nor MyDesigns (including their officers, employees, and partners) will be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of or related to your use of the Store or any product purchased through it. To the maximum extent permitted by law, the total aggregate liability of the Seller and MyDesigns for any claim arising out of a purchase is limited to the amount you paid for the product(s) giving rise to the claim. Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

14. Dispute Resolution and Arbitration

Please read this section carefully — it affects your legal rights.

Informal Resolution First

Before initiating any formal proceeding, you agree to first contact the Seller at [email protected] (and, if unresolved, MyDesigns at [email protected]) describing your dispute, and to allow 30 days for us to attempt to resolve it informally. Most concerns can be resolved quickly this way.

Binding Arbitration and Class Action Waiver

Any dispute or claim relating in any way to your use of the Store or to any products purchased through it that is not resolved informally will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that (a) you may assert claims in small claims court if your claims qualify, and (b) either party may seek injunctive relief in court for infringement or misuse of intellectual property. The Federal Arbitration Act governs the interpretation and enforcement of this section. You and we agree that any proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If this class action waiver is found unenforceable as to a particular claim, then that claim (and only that claim) must proceed in court.

Your Right to Opt Out

You may opt out of this arbitration agreement within 30 days of your first purchase from this Store by sending written notice that includes your name, order number, and a statement that you wish to opt out of arbitration to: MyDesigns, Inc., 732 S 6th St #4425, Las Vegas, NV 89101, or by email to [email protected] with a copy to [email protected]. Opting out of arbitration does not affect any other part of these Terms.

15. Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to its conflict of laws principles, except that this choice of law does not deprive you of mandatory consumer protections available under the laws of the state in which you reside.

16. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the current version. Changes apply prospectively; the Terms in effect at the time you place an order govern that order. Your continued use of the Store after changes take effect constitutes acceptance of the updated Terms.

17. General

If any provision of these Terms is found invalid or unenforceable, that provision will be limited to the minimum extent necessary and the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Shipping Policy, Refund & Return Policy, Privacy Policy, and Cookie & Advertising Policy, constitute the entire agreement between you and us regarding the Store.
